§1. Introduction and Scope
This page sets out the Terms of Service (the "Terms") that govern your access to and use of the website at baerskintactical.com and its regional sub-paths (the "Site"), and any purchase of goods through the Site.
Merchant of record. Orders placed from your region are sold by Digital Advice LLC, a Delaware limited liability company with registered address 1111B S Governors Ave STE 39353, Dover, DE 19904, USA, trading as BÆRSkin Tactical Supply Co. In these Terms, "BÆRSkin Tactical", "we", "us", and "our" mean Digital Advice LLC.
By accessing the Site or placing an order, you agree to be bound by these Terms together with our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Site or place an order.
You represent that you are at least the age of majority in the jurisdiction where you reside, or that you are the age of majority in the jurisdiction where you reside and you have given us your consent to allow any of your minor dependents to use this Site.
These Terms apply to consumers. Business and wholesale purchases are made under separate written terms (see §4.4).
§2. Eligibility and Account
You may browse the Site without an account. To place an order you must provide accurate contact, billing, and shipping information. You are responsible for the accuracy of the information you provide and for any activity under any account you create.
We may refuse service, cancel orders, or terminate accounts where we reasonably suspect fraud, abuse, or breach of these Terms. If we cancel an order we have already accepted, we refund any sums paid for that order.
§3. Products, Pricing, and Availability
Product descriptions, photographs, and specifications are provided for general information. We make reasonable efforts to ensure product descriptions, images, sizing, and specifications are accurate. Minor variations may occur.
Prices are displayed in euros and include VAT. Delivery charges, if any, are shown before you place your order. Import duties are included in the price. We may change prices at any time without notice; the price applicable to your order is the price displayed at the moment you place the order.
Availability is not guaranteed. If a product becomes unavailable after you place an order, we will notify you and offer a replacement, refund, or cancellation.
§4. Orders and Payment
Placing an order constitutes an offer to purchase. Your order is accepted only when we send an order confirmation. We reserve the right to decline an order at any time prior to acceptance.
Payment is taken at the time of order. Accepted payment methods are listed at checkout and may include credit and debit cards, PayPal, Apple Pay, and Google Pay. By providing payment details, you authorize us and our payment processors to charge the order total.
We reserve the right to verify identity and run fraud-screening checks before fulfilling any order.
4.1 Purchases for personal use
You may purchase Products only for personal, family, or household use — whether for yourself or for an intended recipient — and not for resale, redistribution, or other commercial exploitation. By placing an order you represent that your purchase is for such personal use and not for resale.
4.2 Quantity limits
We may limit the quantity of Products that may be purchased per order, per account, per payment card, per person, or per household. We may apply these limits at our discretion and without prior notice.
4.3 No resale
Reselling, or offering to resell, our Products in the course of trade — including through online marketplaces, auction sites, or other retail or wholesale channels — is not permitted under these Terms. Nothing in these Terms stops you from later selling or giving away a Product you bought for personal use. We reserve the right, without prior notice, to refuse service to any customer, and to reject or cancel any order in whole or in part and refund any money paid for it, where we reasonably suspect that an order is placed for resale or is otherwise inconsistent with personal, family, or household use (for example, based on order quantity, frequency, shipping destination, or payment patterns).
4.4 Wholesale and resale enquiries
If you wish to purchase our Products for resale or in wholesale quantities, separate terms apply. Please contact us through our wholesale page to discuss an authorized wholesale or reseller arrangement. Any resale of our Products is permitted only under a separate written agreement with us.
§5. Delivery
We aim to dispatch orders within the timeframes shown at checkout. Delivery times are estimates and not guarantees. Title passes to you on delivery. Risk of loss or damage passes to you when you, or a person you nominate other than a carrier you engage yourself, take physical possession of the goods.
Orders are shipped from a combination of local and international warehouses and usually arrive in 10 to 14 business days. If an item is marked as a pre-order, it ships as soon as it is back in stock, and the same delivery times then apply from dispatch. During holidays, peak periods, or restocks, delivery times may extend up to 30 days. Business days do not include weekends or public holidays. Order updates will be sent continually, and we will contact you directly should there be any significant change to your delivery.
If your order has not arrived, please contact us within 60 days of your purchase date so we can trace it with the carrier and arrange a refund or replacement. Contacting us later does not remove any right you have under applicable law.
Where we fail to deliver within 30 days of order, you may set an additional reasonable period for delivery; if we fail to deliver within that additional period, you may treat the contract as terminated. This right is in addition to any other rights you may have under applicable consumer protection law.
§6. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, war, sanctions, government actions, civil disturbance, labor disputes, or transport disruption. Where such an event continues for more than 60 days, either party may terminate the affected order for refund of any sums paid. This section does not limit any right you have under §5 or applicable consumer law to cancel earlier.
§7. Manufacturing and Sourcing
Our products are designed by BÆRSkin Tactical and manufactured through selected partner facilities, including in China, under our quality and production standards.
§8. Cancellation
You may cancel an unshipped order at any time before it leaves our warehouse by contacting customer support. Once an order has shipped, the cancellation provisions in §Returns and Refunds apply.
8.1 Post-purchase offers
Some purchases include a follow-on post-purchase offer accepted at a discount immediately after the initial order. Because the post-purchase offer price is conditional on the initial purchase, the following cancellation rules apply while orders are still processing:
- You may cancel both orders together while either is still processing.
- You may cancel the post-purchase offer only while it is still processing and keep the initial order on its original terms.
- If you cancel the initial order, the post-purchase offer is also canceled, because its discounted price was conditional on the initial purchase. Both orders are then refunded in full.
Once either order has shipped, the provisions in §Returns and Refunds apply. If you cancel or return the initial order under a right given by law (including the 14-day right in §9 where it applies to you, or a remedy for faulty goods under §12), we refund everything you paid for the initial order with no reduction.
§9. Right of Withdrawal (Cooling-Off Period)
You have the right to withdraw from a distance contract for goods within 14 days without giving any reason, under EU Consumer Rights Directive 2011/83/EU. The 14-day period begins on the day you (or a third party other than the carrier indicated by you) acquire physical possession of the goods.
To exercise this right, inform us by an unequivocal statement (for example, through our contact form). The 14-day right runs in parallel to our 60-day return window (§Returns and Refunds); whichever is more favorable to you applies.
You may use the model withdrawal form below, but you do not have to. You can also withdraw on your order page, which you reach through Find my order. Send the goods back to the address we give you without undue delay and in any event within 14 days of telling us that you withdraw. You bear the direct cost of returning the goods. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

Statutory exclusions. The right of withdrawal does not apply to:
- Goods made to your specifications or clearly personalized
- Sealed goods that are not suitable for return for health or hygiene reasons and that have been unsealed after delivery, including underwear and socks once the seal is broken
- Goods that are, by their nature, inseparably mixed with other items after delivery
If you exercise your right of withdrawal, we will reimburse all payments received from you (including standard delivery costs) without undue delay and within 14 days of being informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them.
§10. Returns and Refunds
We accept returns within 60 days of delivery. To be eligible:
- The item must be unused, in its original condition, with all labels and tags attached, and (where applicable) in its original sealed packaging
- You must contact customer support to initiate the return and receive return instructions
- Return shipping is at your cost unless the return is due to our error or a defective product
The following items are excluded from return:
- Items marked "Final Sale" at the point of purchase, where they are made to your specifications or are clearly personalized
- Underwear and socks, which are non-returnable and non-exchangeable for hygiene reasons
- Gift wrapping and gift cards (unless provided digitally and unredeemed, where local law requires)
For returns under this policy, we cannot refund products shipped before contacting our team, nor items sent to any address other than the one provided by our support agents. This does not apply to returns you make under your legal rights. Please include your name and order ID inside the parcel so we can identify it quickly and process your refund without delay.
Refunds are issued to the original payment method within 14 days of our receipt of the returned item.
Peak-season delays. During the December–February peak and post-holiday return period, refund processing may take longer than the 14-day target above due to higher return volumes. We will keep you informed and process your refund as quickly as possible. This does not affect any shorter, non-waivable refund period required by your local consumer protection law (see §Right of Withdrawal and §Statutory Consumer Guarantees).
Statutory rights. The 60-day return window above is offered in addition to your statutory rights, including the 14-day right of withdrawal (§Right of Withdrawal). Where statutory rights are more favorable than this policy, the statutory rights apply.
BÆRSkin Inner Circle members. On orders you place as a member, the return window is 180 days from delivery (§33.7).
§10A. Exchanges
If you want to swap the product for a better-fitting one, our Fit Guarantee has you covered. Contact our support team through our Contact form and they will assist you with the exchange.
The exchange window depends on when your item was delivered:
- December–June: Exchange within 60 days of delivery.
- July–November: Exchange until January 31 of the following year, so you can shop early for Christmas with complete peace of mind.
All exchanges are subject to size availability. If your requested size is not currently in stock, our support team will work with you to find the best alternative. Where we need the original item back, return postage is at your cost unless the item is faulty or we sent the wrong item.
BÆRSkin Inner Circle members. On orders you place as a member, the exchange window is 180 days from delivery or the window above, whichever ends later (§33.7).
§11. Warranty
Unless stated otherwise on the product page, the following applies to our products:
- Damaged on arrival. If your item arrives damaged, you must report it within 60 days of delivery and include photo or video evidence so we can assess the damage and arrange a replacement or refund.
- 6-month wear warranty. If an item is damaged during normal wear within 6 months of delivery, you may be eligible for a replacement or refund. Eligibility is assessed case by case based on the photo or video evidence you provide.
- Exclusion. The warranty covers defects in materials or workmanship that appear during normal wear. It does not cover damage caused by incorrect handling, misuse, accidents, or the gradual effects of normal use.
This commercial guarantee is given by Digital Advice LLC, 1111B S Governors Ave STE 39353, Dover, DE 19904, USA. To claim, contact us through the contact form at baerskintactical.com/eu/contact-us within the period above with your order number and photo or video evidence. Your legal guarantee of conformity under §12 is free of charge and is not affected by this commercial guarantee.
These warranties are in addition to, and do not affect, any non-excludable warranties or guarantees you may have under applicable consumer protection law.
§12. Statutory Consumer Guarantees
Conformity rights. Goods supplied to you must conform to the contract. Where they do not, you have rights under EU Directive 2019/771 to repair, replacement, price reduction, or termination, subject to the conditions in that Directive. These rights are in addition to any commercial warranty we offer (§Warranty).
Mandatory consumer rights. Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law of your member state of residence that cannot be excluded by contract.
§13. Free Gift Card Terms
Where we offer a Free Gift Card with qualifying purchases:
- The Gift Card is awarded once the order ships and qualifies under the promotion terms shown at the time of purchase
- Gift Cards are calculated on a pre-tax, pre-discount basis
- Gift Cards are non-transferable, non-redeemable for cash, and expire 12 months from issue unless local law requires otherwise
- If the underlying order is canceled or returned under our voluntary returns policy, we may cancel an unused Gift Card or deduct the used value from your refund, as stated in the promotion terms
§14. Communications: Email
By providing your email address you consent to receive transactional and service communications relating to your account and orders. You may opt in to marketing emails through our preference center or at the point of email signup; you can unsubscribe at any time using the link in any marketing email or by contacting customer support.

§16. User Content
If you submit content to the Site (reviews, photos, comments, social posts tagged to us), you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in any media for the purposes of operating, marketing, and improving the Site and our products.
You represent that you own the content you submit, that it is accurate, and that it does not infringe the rights of any third party. We may remove or refuse to publish a submission that breaches §17, is spam, is not based on a genuine experience of the product, or is unlawful. We do not remove or hide reviews because they are negative.
§17. Acceptable Use
You agree not to use the Site to:
- Engage in unlawful activity, harassment, or fraud
- Submit content that is defamatory, obscene, hateful, or infringing
- Probe, scan, or test the vulnerability of any system or network
- Use scraping, crawling, or automated tools to extract content for commercial purposes
- Misrepresent your identity or affiliation
- Interfere with the operation of the Site or any user's access to it
We may suspend or terminate access for breach of this section.
§18. Intellectual Property
The Site and its content (text, graphics, logos, product photography, software) are owned by us or our licensors and protected by intellectual property law. The marks "BÆRSkin Tactical", "BÆRSkin Tactical Supply Co.", and associated logos are trademarks. Nothing in these Terms grants you any right or license to use these marks except as expressly permitted.
We respect the IP rights of others. If you believe content on the Site infringes your rights, contact us at the address in §Contact.
§19. Disclaimers
Except as expressly stated by us and except where applicable consumer law requires otherwise, the Site and all products and services delivered through the Site are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, or non-infringement.
Nothing in this section excludes or limits any rights you have under mandatory consumer protection law that cannot be excluded by contract.
§20. Limitation of Liability
To the fullest extent permitted by law, we and our officers, directors, employees, agents, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising out of or in connection with your use of the Site or any product, whether based in contract, tort, statute, or otherwise.
The limitations in this section do not exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
§21. Indemnity
You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your misuse of the Site, or your violation of any law or third-party right.
§22. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
For consumers resident in the European Union, the United Kingdom, or Switzerland, these Terms are also subject to mandatory rules of the law of your country of habitual residence that cannot be derogated from by agreement.
§23. Pre-Dispute Notice
Before filing any claim, you agree to first contact us in writing through our Contact form and provide:
(a) your full name, mailing address, and email address;
(b) a description of the nature and basis of the claim;
(c) the relief sought;
(d) the date of the events giving rise to the claim;
(e) a copy of any communications between you and us relating to the claim.
We will respond within 30 days. If the claim is not resolved within 60 days of our receipt of your notice, either party may proceed under the dispute resolution provisions that follow.

§27. Court-Based Dispute Resolution
If the claim is not resolved through §Pre-Dispute Notice, you may bring claims in your local courts of competent jurisdiction. Mandatory consumer protection rights of your country of habitual residence apply.
You may also contact your national consumer protection authority or a consumer dispute resolution body in your country.

§29. Modifications to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this document reflects the most recent change. Material changes take effect 30 days after we post the updated Terms (or, where required by law, after we provide notice). Your continued use of the Site after the effective date of a change constitutes acceptance of the updated Terms, except where local law requires explicit acceptance.
The version of these Terms in force when you place an order applies to that order. We do not maintain a public version archive.

§31. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and any order confirmation, constitute the entire agreement between you and us relating to the Site and any purchase.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect to the fullest extent permitted by law.
No waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any affiliate or successor without notice to you, provided this does not reduce your rights under these Terms or applicable law.
Headings. Section headings are for convenience only and do not affect interpretation.
Language. These Terms are drafted in English. The English version controls in the event of a conflict, except where local law requires otherwise.

§33. BÆRSkin Inner Circle Membership
33.1 The membership and its price
The BÆRSkin Inner Circle (the "Membership") is a paid monthly membership. It costs €5.99 per month, charged in the currency of the store where you join. You can join at checkout when you buy goods. The Membership is available in the stores for the United States, Canada, the United Kingdom, the European Union, Switzerland, Australia, and New Zealand. It is not available in the global store.
33.2 Automatic renewal and payment
The Membership renews automatically every month until you cancel. We charge €5.99 to the card you use at checkout on the day you join, and then once a month on the same day of the month, until you cancel. We save that card for the monthly charge. PayPal is not available with the Membership in the cart, because the monthly charge needs a saved card.
33.3 Eligibility
You need a delivery address in the region of the store where you join. We do not offer the Membership with a delivery address outside that region. The Membership is linked to the account with the email address of your order.
33.4 Failed payments
If a monthly charge fails, your account shows "Payment failed". You can choose another saved card in your account to retry the charge. We may pause your member benefits until the charge succeeds. If the charge stays unpaid, we may end the Membership.
33.5 Cancelling
You can cancel at any time online in your account at Account > Membership with "Cancel membership". You can also ask our support team to cancel for you. After you cancel, we do not charge you again. Your benefits continue until the end of the month you paid for. We do not refund part of a month, except where a statutory right gives you a refund or you withdraw under §33.9.
Cancellation by us. We can cancel your Membership at any time. We tell you by email when we cancel. If we cancel, we refund all the monthly fees you paid for the Membership to your original payment method within 14 days. We do not charge you again. Your member benefits end on the day we cancel. Unspent cashback credit ends with the Membership. A voucher you already received stays valid. Orders you placed as a member keep their 180-day return and exchange windows. This paragraph does not apply when we end the Membership for an unpaid charge under §33.4.
33.6 Notices
After you join, we send you an email with these terms, the price, the billing frequency, and how to cancel. We send you a reminder once a year. If we change the price or these Membership terms, we tell you by email 30 days before the change takes effect, with the steps to cancel.
33.7 Member benefits
- Free standard shipping on every order while you are a member, including the order in which you join.
- 180-day returns and exchanges on every order you place as a member. This replaces the 60-day return window in §10. For exchanges, you get 180 days from delivery or the window in §10A, whichever ends later. All other conditions of §10 and §10A apply.
- Cashback. You earn a €25 credit on an order with a merchandise subtotal of €60 or more after discounts. The order in which you join earns no credit. You can hold one unspent credit at a time. You can spend it on a later order with a merchandise subtotal of €60 or more. A credit expires 90 days after we issue it. You cannot spend a credit on gift cards or together with a gift card. A credit and a coupon do not combine: when both apply, we apply the bigger discount. A credit has no cash value and ends when your Membership ends.
- Refunds after cashback. If you return an order that earned a credit and you already spent that credit, we deduct the credit from the refund for that order. The refund breakdown shows the deduction as a separate line.
- Voucher. After every 12 paid months, you get a €75 voucher. The voucher has no minimum spend and does not expire.
33.8 Your statutory rights
Nothing in this section limits your statutory rights as a consumer (see §Statutory Consumer Guarantees).
33.9 Right of withdrawal from the Membership
You have the right to withdraw from the Membership within 14 days without giving any reason. The period starts on the day you join, which is the date of the order where you added the Membership. To withdraw, send us a clear statement by email to support@baerskintactical.com. You can use the form below, but you do not have to.
If you withdraw, we refund the full first monthly fee to your original payment method within 14 days of receiving your withdrawal. We refund the full fee even if you already used member benefits. Your Membership then ends. A withdrawal from the Membership does not affect the goods in the same order; §9 covers those.
Cancelling in your account (§33.5) stops future charges only. It is not a withdrawal and does not refund the first fee. To withdraw, use email or the form.
